Arbitration Agreements in Employment: What You Give Up When You Sign

Buried in onboarding paperwork, many employees sign an arbitration agreement without realizing what it does. These agreements send future disputes to a private arbitrator rather than a court, and they often include a waiver of class actions. The choice has real consequences for how, and sometimes whether, you can enforce your rights.

What arbitration changes

Your case is decided by a private arbitrator, not a judge or jury
Proceedings are usually confidential rather than public
Your ability to appeal a bad decision is very limited
A class waiver can stop you from joining with coworkers in one action

Why employers favor it

Arbitration tends to keep disputes private, limits the size of group claims, and removes the jury from the equation. For an employer facing many similar claims, requiring each worker to arbitrate alone can blunt the leverage that a class action would provide.

Limits on arbitration

Arbitration is not absolute. Federal law now bars forced arbitration of sexual harassment and sexual assault claims, so an employee can choose court for those claims regardless of a signed agreement. Some agreements are also unenforceable when they are unconscionable, hide key terms, or strip away rights the law protects. New Jersey courts scrutinize whether a worker knowingly waived the right to sue.

Read before you sign, but know your options after

If you are asked to sign an arbitration agreement, read it and ask questions. If you already signed one and now have a claim, do not assume it forecloses everything. The enforceability depends on the language, the circumstances, and the type of claim.

Get it reviewed

An attorney can tell you whether an arbitration clause applies to your situation and whether there is a path around it. The answer is often less settled than the document makes it sound.
