Tip Credits and Tipped Wages: When Your Employer Gets It Wrong

If you work for tips, your employer may pay you a lower direct cash wage and count your tips toward the minimum wage. That arrangement, called a tip credit, is legal only when the employer follows strict rules. When it does not, you are owed the difference, and the violations are more common than most workers realize.

How the tip credit works

An employer can pay tipped employees a reduced cash wage as long as your tips bring your total earnings up to at least the full minimum wage for every hour worked. If your tips fall short in a given week, the employer has to make up the difference. The burden is on the employer to track this correctly.

Common violations

Failing to make up the gap when tips do not reach the full minimum wage
Requiring tip pooling that includes managers or back of house staff who do not customarily receive tips
Taking a tip credit for non tipped work, such as extensive cleaning or prep, that should be paid at full wage
Keeping a portion of tips or charging them against breakage and walkouts
Failing to pay proper overtime based on the full minimum wage rather than the reduced cash wage

Tip pooling rules

Valid tip pools generally have to be limited to employees who customarily receive tips, such as servers and bartenders. Owners and managers cannot take a share. When an employer forces tips to be shared with ineligible staff, the entire tip credit can be lost, meaning you may be owed full minimum wage for all your hours.

Side work and dual jobs

If you spend significant time on non tipped duties, your employer may owe you the full minimum wage for that time. Mislabeling all your hours as tipped is a frequent and costly error for employers.

Recovering your wages
