National Origin Discrimination and English-Only Rules at Work

Your employer cannot treat you worse because of your national origin, your ancestry, your accent, or the country your family came from. Title VII and the New Jersey Law Against Discrimination both prohibit it, and the protection covers hiring, pay, assignments, discipline, and the day to day treatment you receive.

What national origin discrimination includes

Refusing to hire or promote someone because of their ethnicity or birthplace
Harassment based on accent, language, or cultural background
Assigning less desirable work to employees of a particular origin
Holding an accent against an employee when it does not affect job performance

English-only policies

Employers sometimes require English in the workplace. A rule like this is lawful only if it serves a real business need, such as safety or effective communication during specific tasks, and it has to be limited to those situations. A blanket rule that forbids any other language at all times, including breaks and private conversations, is hard to defend and can itself be evidence of discrimination.

Accent and fluency

An employer can require the level of English a job genuinely needs. It cannot reject or penalize you for an accent that does not interfere with your ability to do the work. Using accent as a stand in for national origin is unlawful.

Citizenship and work authorization

Federal law also bars discrimination based on citizenship status against workers who are authorized to work. Employers have to verify eligibility, but they cannot single out workers of a certain background for extra scrutiny or demand more documents than the law requires.
